    Default Can someone that's not the father sign a certificate?

    My story is complicated. I was in a bad relationship and got pregnant. Im four months pregnant now and Im in a new relationship with a wonderful guy. My ex hasn't done anything for me or the unborn baby, doesn't want to go to drs appointments or anything like that, but the new guy has done it all. We are telling the ex that it's a bigger possibility that it's my new boyfriend's rather then his. His thing is he claims he will be there when the baby is born and the new boyfriend wants to be there too. If I could have it my way I would have the new boyfriend sign the birth certificate and my ex just leave us alone. So say I have the baby and my current boyfriend signs the birth certificate, can the ex come by and demand a DNA test and we have to give it to him? Or would he have to leave us alone since the other guy's name is in the certificate?

    Intentionally naming the wrong person as the child's father will not prevent the biological father from initiating a paternity action, to try to get legal rights to his child.

    I say if you really want to be with the new guy then you all should get married. Say you all became pregnant before deciding to get married. When the child is born he/she may automatically become a birth of the marriage and the biological won't matter. Besides, the only way he could show up for the delivery of the child is if you tell him. If it's only you and your husband then the two of you complete the birth certificate forms and maybe it won't be a problem.

    I'm kind of going through something similar to this. There are all sorts of loop holes in our laws, but it seems that whoever does the replying around here won't acknowledge them and is more interested in the deadbeat biological's paternal rights. The biological sounds like a real loser and I doubt he really cares about any rights. Go figure.
