My question involves unemployment benefits for the state of: Massachusetts
I most recently worked through a temp agency for a local manufacturing company. In my opinion, things were going very good, I was repeatedly asked to stay late and to come in for extra work. It went on like this for just about three months. Shortly after my second month however, (maybe two and a half monthis into working there) I found out the good news that I was expecting a child. So it was known, I informed both my temp agency and the company I reported to for work about the news. Both sides seemed perfectly fine with it. The company I reported to even offered to reassign me to a different department so I wasnt on my feet for eight hours straight. Good news right? Apparently not. About a week and a half later, my boyfriend called me and told me that the temp agency had just called and left him a message on his phone that it was very important I not report to work and that I call in to them. So I called the temp agency and I was told that I was being removed from my assignment and was offered no explanation why. Though I found it strangely coincidental that it happened a short time after telling them I was pregnant, I have no proof that was there motive. I had recently moved into a new house however and couldnt afford to be out of work so I was told to file for unemployment as I had worked steadily over the previous couple years. I went in and was told that I was eligible and told how to file, etc. So I began filing my claims and on the second week, I was told I had to speak to an adjuster because they were receiving reports from the temp agency that I ahd been fired... ??? I was never told I was being fired, never written up at work or reprimanded in any way. How could I be fired? And only being told this after I start to file for unemployment?? I contacted my temp agency and was told that the employer stated they fired me for smoking and cell phone use. The only problem with that is that I dont smoke, and even if I did, Im pregnant and therefore wouldnt have been smoking during the time of employment. Though I did associate with coworkers who smoked and occasionally sat with them on the only benches provided, off of company property while on breaks. The three people I assocaited with are still to this day currently employed. And the other reason, the cell phone, is just as laughable seeing how I dont have a cell phone. The company and the temp agency both have my boyfriends cell number as a contact number due to the fact that I dont have a phone. So that being said, Im still searching for work to no avail. Its very obvious now that Im pregnant and though it hasnt been said, I doubt any company will take a chance on hiring a pregnant woman who will be out on maternity leave shortly after being hired. I still report my claims to MA unemployment every week but it just says being processed every week for the last eight weeks. I havent been contacted by anyone else and my bank account is going to be empty at the end of the month once the next rent check is withdrawn. Due I have any legal ground to stand on. I have strong reason to believe I was let go due to being pregnant and now they're being dishonest about why I was let go. I got a letter from my temp agency a week after being unassigned saying I need to go to a doctor and have them put in writing that I'm physically able to work. Is that legal?
