    Default Debts from a Parent

    My question involves collection proceedings in the State of:NYC

    So I'm 21 years old, my mother dies, & now her debt agencies have been calling me, saying they want me to pay back her debts. I get letters at least once a week saying that they want me to pay back her debts. The debts are in the $2-3,000 range, & I'm not even working. I looked online & from what I see, I'm only responsible if
    1) I was married to her.....yeah right
    or
    2) I cosigned on her accounts, which I didn't.

    I also heard that credit card companies do things like this when a parent dies just to trick the kids into recovering the debt. I have been not to pay anything (which I havent) because if I pay even a dollar on the debts, I will be legaly accepting the debts. your opinions? Am I officially debt riddled at 21?!?!

    Are they expecting you to pay from yur own pocket, or are they trying to get money from your mother's estate?

    i dont believe you would be liable.you did not make the debt.that would come out of your mothers estate.if its unsecured debt though.that could be why there pushing you so hard ,they are despirate.they dont have the right to constantly bother you like this.send them sease and desist letters to leave you alone.you deserve the peace right now.

    As scruit suggests, they can make claims with your mother's estate. If her estate was properly probated, with notice to her creditors and a final, court-approved distribution of her assets, the issue should be closed.

    What was the disposition of your mother's estate?

    You don't inherit debts - you can, and should, tell the creditors not to contact you any more.

    This is the cease & dissist letter I am planning on sending them:
    Dear Sir or Madam:
    This is in reference to my mother’s debts. I am receiving constant correspondences from your company saying that I am to pay back my mother’s debts. I have spoken with an attorney & I know I am not legally responsible for her debts. Debts from parents are not inheritable by the child, I did not cosign her accounts, & I did not marry her. As such, I do not satisfy the conditions to inherit her debts. This is a cease & desist letter to your company. Stop sending correspondences to me in reference to my mother’s debts or I will take legal action against you for harassment. This is the only letter I will be sending you in reference to this letter & I expect to not be contacted again. As I have previously stated, if I receive another correspondence about this matter from your company, I WILL take legal action against your company for harassment.

    Sound good? I was told to make it sound as professionally angry as possible & to threaten to take legal action. I've heard that usually gets them running.
