My question involves unemployment benefits for the state of: Pennsylvania

I have been denied benfits in Pa. for the following reasons Section 402H
of Pa Unemployment Comp Law.
Reasons:
Claimant is an officer of Corporation
Owns 100 % of stock
Has substantial control (or has the right to have sustantial control) over daily operation of corp.
Therefore is self employed and is denied benefits.

[B]I do not agree with this this because:[/B]
The Corporation is a construction company. The economy has crushed the reidential renovation market if the western burbs of Philadelphia.

If I ran a grocery store and failed then I would agree that I was not good enough at my job. But residential construction is market driven. With the way the economy has colasped (thanks to whom I don't know) I stopped doing business under the corp.

This corp. involves only myself and one emloyee. I let go of the other employee 4 weeks prior.
The corp. was required to pay into uc fund for my wages and did pay. I was on the payroll.

The corporation has no assets. The "stock" is worthless. The corp. has debt and a judgement against it. It is negative several thousands of dollars.


My take is :

I was not in control of the company as result of historical market crash in my industry.

The stock can't be owned if it's worthless or, It is no longer stock if it has no value.

I can't be self-employed because i am not employed at all. The busioness has ceased operation.

The business is technically bankrupt but has opted to close and save money on attorneys instead of filing bankruptcy.

The corporation has paid "Insurance premiums" for my unemployment benefits.

If anyone could offer some suggestions it would be greatly appreciated.
