    Default Advise for Criminal Court Case

    My question involves criminal law for the state of: New York


    I shop lifted from Macy's worth $171, I plead guilty, the judge ordered I do 1 day of community service and pay a $120 surcharge fee, if I don't I would do 15 days jail time. This court appearance was in December of 2009 I told the judge and showed a document stating I had to have a hip replacement on February 12th of 2010, that time has passed and I had the hip replacement and all doctors letters to prove it, and a scar of course. I won't be able to do the 1 day of community service under these circumstances or pay the $120 at this time. I'm still healing and my court case is March, 12th 2010. The problem won't be getting to court, but does anyone think after I show all my hospital documents, the judge could maybe give me some more time? Would the judge actually be able to throw me in jail for 15 days after I just had a hip replaced??? I'm aspiring to be a medical student, I know I made a mistake, it's a misdemeanor, could this really haunt me?

    Why should the judge give you any more time. You had from December 2009 all the way until your surgery to take care of business!!!

    He certainly is not going to care about your hip. If you can sit at home and feel sorry for yourself, you can certainly do that in a jail cell too.

    With all due respect lets see, I had osteoarthritis in my right hip, no cartilage between the two bones, I could barely walk and get to college. How could I have done community service under those circumstances? Sat home and felt sorry for myself? I'm a 21 yr old college student with a newly replaced hip, this is a misdemeanor for 170 dollars, you're telling me non of my medical problems are valid enough???

    You had roughly 2 months to do the community service - but you chose not to. If I were the Judge, that's what I would look at. You have ample time to perform 1 day of community service. Good luck.

    I had Community Service 3 years ago after a car accident. I was wearing a back brace.

    They worked with me on it. 3 months to do 40 hours. They found a place where the work fit within my 10-lb lifting restriction. Goodwill worked with me on my hours - as I was feeling pain, I would do 2-3 hours at a time, and they were fine with that.

    While I sympathize with your pain, you could have explained the situation, shown doctors notes, and they would have worked with you on it.
