My question regards South Carolina law.

Three years ago, my mom was assaulted by two of her sisters at their mother's house. My mom called the police. The police interviewed my mother, the perps and witnesses. (note: the witnesses were interviewed in front of the perps).

The police advised my mom to let this blow over and to not file charges. He didn't think there was enough evidence to convict. My mom said she had let this kind of behavior go on too long and something needed to be done. The cops have been called to that house numerous times for domestic violence, none of which had ever involved my mom.

My mom swears out a warrant and the sisters are arrested. During some pre court hearings and meetings, the DA tells my mom that she can proceed but that he did not think there was enough evidence to proceed. Basically it was a he said / she said kind of deal. In the meantime, my mom's mother passes away due to cancer. My mom decides the emotional stress is too much and drops the charges.

Now she is being sued by the sisters for false arrest. Does my mom need a lawyer? Is she in danger of losing?
