    Default Declaration from a Manufacter to Use Pictures for Commercial Use

    Good Morning,

    First of all we are happy we have found this great forum!

    We are working for a french fashion brand, we would like to expand our market and for this reason we have found a good manufacter in Asia.

    Now we would like to sell these styles on our website. The manufacter can offer us very high quality and professional pictures. We can use these pictures without restrictions.

    We would like to use the professional pictures on our website and marketing tools.

    So we have asked to the manufacter if he is the owner of all the pictures and model and he has confirmed that.

    We want to present to the manufacter a declaration where he subscribe us that he is the full owner of the pictures and we have the completly right to use their on our website etc for a commercial use.

    He has accepted our request, so now the question is, can somebody tell me please where to find (or how to write....) a standard documents with all the details which can protect us?

    We dont wanna have problems in future with models, photografer, other company etc.

    Maybe someone else will go out on a limb.

    However, this is a US forum. You really need an attorney in your country, the country where anything would be litigated, to write a proper document for you. There is no cheap way around that.

    U.S. and France (or other European countries) have VERY significant differences in civil and corporate law. I am sure this extends to copyright and other intellectual property law. I could write a book just on the differences in discovery and pretrial practice. I can assure you I am not going to do that.

    You need a French intellectual property attorney. Or you could just use standard boilerplate for a photo release and take your chances.

    Come on, get flipping serious. If you have the money to have clothing, especially high fashion clothing manufactured in Asia, you have the money for an attorney. You should also certainly have a law firm that is in France and also has an office in the country you are having the product made in.

    Otherwise, you will be screwed in countless ways. Your fashions will be ripped off and in stores before you even get your order delivered.

    Once you get your order, you update your sales materials, web site, etc. with your own photos with your own models.

    This is for a contract between a company in France and a manufacturer in Asia? This is a U.S. forum - we can't promise you that a clause that might work under U.S. law will be upheld by a French, E.U. or Asian court.

    Yes it should be a contract between a french company and an asiatic manufacter.
    Can you please try to tell us a solution (please imagine that the company isnt french but american).

    Oh yea, like anyone here is going to write up a contract for some stupid cheapstake in France for an asian deal without having any idea of French law or the law in whatever asian country you are dealing with, which you have not even said.

    Did you not read my previous message? You have money to get clothing made overseas, yet you don't have the resources to hire an attorney in your own country? You expect us to save you the money? What kind of a moron are you?

    If you are that cheap and unprepared, you have no business going into that business.

    Why don't you find some legal forum in France and see if there are any suckers there that work for free?
