    Default Communicating Threats to an Ex-Girlfriend

    My question involves criminal law for the state of: north carolina.

    my ex from high school and i were texting each other the other day, we were good friends and everything until she told me something that i did not like on the text so i replied back at her that she was a fat whore, then i called her with my friend doing a 3 way call and asked her if we could come over and "**** her" in a joking matter, then i did not talk to her anymore until at 2 am that same day the cops came knocking on my door saying that i had comuniqued a threat and took me to jail, on the police report says that i said i was going to kill her and rape her but i never really said any of that, so i want to know if i'm guilty or not and if i am not, i want to know how to file a demand against her. thank you for reading.

    If you think that's something to joke about, I see jail time playing a substantial role in your life. Apparantly SHE didn't take it in a joking manner. Bet most of the jury won't either.

    But implied it, "jokingly". That's enough.

    so i want to know if i'm guilty or not and if i am not,
    That's for a judge or jury to decide. Depends on if they get the joke.

    Based on what? Your own words? You're behind the eight ball here - she reported to police what you said, and police agreed that probable cause existed to bring charges against you. You can also expect the court to issue a restraining order against you if she asks for one. Time to grow up and start acting like an adult and THINKING before you act or talk.

    thank you for your reply it was kind of helpful and yes people make mistakes sometimes in this case i had no idea this could happen but here i am. anyways so what you are saying is that if i ASK someone to have sex with them i could go to jail, just because i said that? because thats retarded,i never said to her i was going to rape her or kill her, witch is what the police report says.

    She's your ex. You already set the stage for a conversation with sexual ovetones by calling her a sexually-based slur. It's not a stretch that any reasonable person would have been put off by such a comment, or could have taken it as an implied threat (especially since your implication wasn't that just YOU would be involved, but a friend as well - which has serious overtones of "two against one"). Again, it'll be for a jury to decide. You can most certainly be charged and even convicted of threatening communications or harassing communications even if the actual word "rape" never left your mouth or appeared in the text messages. It'll be looked at as a totality of what was communicated.
