    Default Speeding Ticket in Grant County - Mitigation and Deferral

    My question involves a speeding ticket from the State of: Washington

    I recently got a ticket for going 91 in a 70 (I-90) in Grant County. I'm looking to get a deferral (I currently have a clean record, this was my first ticket), so I sent in the ticket requesting a mitigation hearing (which I'm under the impression is what I was supposed to do). Now, I live in Seattle, so I'm planning on doing this mitigation hearing by mail. However, I have no idea what I'm to write in the Statement of Defendant letter. Do I explain my circumstances, or do I simply acknowledge my speeding and request a deferral?

    So I see that in the bit about Mitigation or Referral it says to ask for a deferral first, and if it is not granted, then explain my circumstance; however, in the quote given ("I, ______________, respectfully request the court to defer findings in this matter. I have not received a deferral within the past seven years, and I do not possess a CDL. If the court will not defer findings, please consider the following mitigating circumstances….”), it tackles both of those in one shot. Would it be better to simply write the bolded part, or should I include my circumstances in the statement as well?

    The court is under NO obligation to grant a deferral. So, if the judge, for whatever reason, decides NOT to grant your deferral, you might want to provide a reason for reducing your fine. If you'd rather pay the entire amount, however, feel free to leave off your explanation of any mitigating circumstances.
