    Default Asset Acceptance Summons

    My question involves collection proceedings in the State of: Indiana

    hi, so this is where its get tricky. Asset Acceptance sent the summons to my parents who live in New Jersey. I have lived in Indianapolis since 2006. Do I have to go to court in NJ?

    Also, My debt is real, and it the last of 8 cards that hasnt been paid off yet. I felt like assect acceptance gave me no notice to make a payment plan with them. I haven't even talked to them on the phone or have gotten anything in my Indiana address. All my credit cards that i defaulted on were being billed to my Indiana address.

    What should i do?

    You can attempt to argue that you're no longer subject to service or suit in New Jersey due to your long-term domicile in Indiana. But if you want to raise that defense, you would presently need to do so in the New Jersey court where the case was filed.

    Why would they sue in New Jersey if they have your current address?

    OMG! I'm in the same boat with Asset Acceptance. I live in PA. My parents are in NJ. I've never lived at their address and all my mail has always gone to my PA address. I'm being sued in my parents county.

    I think I know why they're doing it. 1) There was definately a good chance I wouldn't see the mail and know they were suing me 2) in PA, the SOL is 4 years, NJ is 6 3) NJ can garnish wages, PA can't.

    They've also added fee's and interest since I stopped paying on this account with Citibank and it has nearly doubled. I'm pretty certain they cannot collect additonal fees and interest once the account was written off, yet they state in the lawsuit that they will continue to do so.

    If the case is not dismissed based on jurisdiction, I have about 5 other things I can do after them for based on them breaking FTC laws.
