My question involves criminal law for the state of: NY
I am writing for any information on what to do about a NYS Warrant issues for a Probation Violation in NYS. My husband was sentenced in NYS 1996 and given 5 yrs probation - he was violated 12/99 and served 5 yrs in a State jail in NY. In 2004 he was released after Maxing out no Probation or Parole afterwards. We moved to Colorado in 2006 and have had no issues until just a few days ago. My husband is End Stage Renal with Kidney Failure and now his Social Security and medical have been halted because we just found out a Warrant for probation violation was issued 10/2009. NYS will not extradite for this because I am assuming this is not a criminal issue but a Civil issue. I have contacted NY from probation to the NYS Police Dept that executed the warrant. Found out it was over Monitoring and Supervision fees. Is there not a Statute of Limitations on things like this? Because with no medical and income my husbands benefits will not resume until this is cleared up. Don't they usually issue a civil judgement in cases like this? This is just really frustrating - we had no idea this was even happening.
