    Default Do I Need to Do Anger Management Program

    Hello,

    I was charged for a 2nd deg assault (Aug09) and then on trial was Acquitted - not quilty (Sep09) under spousal privelege. The prosecutor allowed us this option only if I completed a 26 weeks Anger Management (AM)course (which was more of a verbal agreement, unless prosecutor noted in his file)

    I sincerely tried enrolling in Oct, Nov 09 but no spaces were available. I was away in Dec and Jan. Now the program doesn't have spots till April 2010. The AM coordinator said I shouldn't even be going thru this program since it is really for more serious cases than mine.

    In the meantime, my case has been completely expunged.

    MY QUESTION IS -
    Do I still have to do through this AM program?
    I might be leaving the current state due to my job. What should I do in that case?

    PLease advice.

    I can't verify the status of your case, and thus can't verify whether or not you would face consequences if you don't complete the program. I am reluctant to take your story at face value because you say you were acquitted at trial, but then turn around and say that your acquittal was an "option" offered by the prosecutor - an acquittal is a finding of "not guilty" by a judge or jury, and the prosecutor has no further say at that point.

    I had an argument with my wife, I slapped her in anger, she called 911. On trial she invoked her spousal privelege. The prosecutor said he would let my wife do this if I undergo the Anger management program. The judge's decision was Acquittal - Not guilty.

    given the situation, what should I do?

    Taking that at face value, I doubt that the prosecutor has any authority to make you complete the program. But as was said, we can't investigate your situation for you.
