I was arrested in Williamsburg, VA while "stumbling" across a road on my way home from a party. I was arrested, and spent the night in a regional jail, but at no point did they submit me to a BAC. To set things straight, I WAS drunk (most definitely) and, while I was cooperative the whole time and never directly admitted to drinking underage, it was fairly obvious to the officers on duty that I was intoxicated. Public defenders are not assigned in cases like these, so I'm wondering, is there any point in fighting the charge due to the fact that they did not record my BAC? or should I just plead guilty because their word will be considered greater than mine in a court of law?
any help would be much appreciated..
