My brother is from Mexico. When he was a minor, he had a border crossing card to visit the U.S., always kept by our mother. In one ocassion, when he was 16 years of age, he decided to cross the border with a friend who was driving a vehicle. My brother decided to cross the enter the U.S. with a border crossing card of a friend who looked very much like him. Of course, they were sent to secondary inspection. His friend's car was seized, his BBc cancelled and my brother, while insisting to be the person named in the border crossing card he was carrying, his wallet was later found under the passenger's seat with all his documentation under his true full name.

My questions is: For I-212 purposes, is a minor (age 16) held responsible for his actions? Can he claim that he was a minor and could not realize the consequences of his acts? Would this be a good argument to support a I-212? What should he do now (he is 32 years of age) to file I-212 and get it approved. He is very successful in his profession and has been invited to represent the company he works for at several workshops and seminars throughout the U.S.
