    Default Complaints That Result in Employee Termination

    My question involves labor and employment law for the state of: New York.


    Need some insight on my current workplace situation. I am out on vacation until next week but have been given a heads up by a coworker that a detective called from a local precinct verifying some info about me like my employment in their company and my work schedule. He said that he cannot go into any details at this point and that information he can offer is that they're investigating a claim made against me, personally, by one of our clients and that they will be receiving a registered letter in the instance that the client decides they wish to involve the company in this matter as well.

    I have absolutely no idea what this could be about however also happen to have a crazy ex-girlfriend who will stop @ nothing to sabotage any aspect of my life and I can't say that I am sure she is behind this but I also can't say I am sure she is not. I am feeling apprehensive about returning to work & the possibility of being fired. my question - what IS the possibility of me getting fired because of this call, anyway?

    Oh or even worse, is letting me go a "must-do" at this point as a security measure? I'd just like to know, realistically, what can I expect to happen now? And are all allegations assumed true unless proved otherwise by the accused or is the accuser the one who must "prove their case?

    Seriously, we cannot answer that. Your employment status is up to your employer and your employer's company policies.

    You need to go talk to your HR people.

    I personally would do nothing until something else happens or someone approaches you. (In many companies, talking to HR about an issue can cause a file to be opened about it). At this point, you really know nothing. You don't know if the caller was a real detective. You have limited knowledge of who the caller talked to and what was actually said.

    I would think that if you had been involved in an incident with a client that could result in a criminal complaint, you would know something about it. Police do not investigate "claims" (implies civil actions); they investigate crimes.

    Wait to see what happens before blowing the incident into a major problem at the company. It may be your xgirlfriend having someone call and pose as a detective to cause you problems; it may be something else entirely. If, of course, your management or HR initiates communication with you about it, do all you can to find out the nature of the problem without admitting guilt. If it appears that they are talking about something that looks like a criminal complaint, it would be good to get an attorney involved.
