    Default Notice Required Before Increase in Utilities Rates

    This may not be the correct forum for my question, but I’ll post my question here anyway. When it comes to real estate, city or county laws or other issues that deal with a town’s legislation, there a lot of people on this site that know their stuff.

    Does a town or city have to give notice before increasing utilities? In this case it would be a increase in the town’s water and sewer cost. The increase was approved by the town council in the 1st of March town council meeting. I have read the minutes from all town council meetings through January 2009 to March 2010 and nowhere does it mention that the town was entertaining a rate increase. When our power company (Duke Power) announced they were seeking a rate increase, town hall meetings were held throughout the state to discuss the increase. Where in most cases these meetings don’t have a large turn out (as Duke Power is pretty much going to do what they want to do anyway) the meetings are held none the less.

    I understand that there’s a big difference in a utility company that operates in four states versus the town’s water and sewer service, but I believe the people of the community should have a right to voice their opinion. Thanks.

    Duh? Like we have ESP. You don't id the state or the town. Like anyone is even going to know the utility regulations in your town. Give me a flipping break.

    Chances are it is set by state law or whatever empowering legislation or ordinance created the agency/service. That is what you need to look up. That is probably locally available. If you care, do your homework.

    You will have to research the laws of your undisclosed state, and the ordinances of the undisclosed city, to determine what notice requirements are required. Did you check to see if the rate issue was on the agenda for the meeting, and if the agenda was available in a manner consistent with state and local law?

    Laws are different in each state.
