My question involves landlord-tenant law in the State of:
New Jersey

We (my mother and I) have been living in our apartment for approximately 3 years, and in that time the original landlord passed away and the duties were passed along to his daughter.

Just recently a couple with their 4-5 year old son moved into the one bedroom apartment next to us (there are only two apartments in this building).

I believe that NJ state law states that no more than 2 people can move into a one bedroom.

So my first question is does the child count as a 3rd person?


My second concern is that they are all very noisy at night from 9pm on. It seems that most nights I cannot sleep in my own room anymore. They allow their child to jump on the bed which rattles my wall and bed, and he runs around it sounds as though an elephant lives next door. I am aware that they legally have the right to make noise until 11 pm, although I was informed by the police that if the noise is adversely affecting me I can call in a noise complaint at any time. I have called the landlord twice...and she told me that there will be some noise, and does not seem to care. After my call last night to her, she told me that "I am not always on call." meaning that I shouldn't have called her for the noise disturbance. I am furious that I am not able to sleep in my own room...not to mention that she does not take any concern with the building at all.

Is there anything more I can do?
