    Default Denied B2 Visa

    Hi,

    I am a UK citizen, and have been a regular traveller to the US under the Visa Waiver Programme (5 visits since Sep '09, for durations of 2 to 4 weeks, to stay with my girlfriend). I was advised on my last entry to the US (Jan '10) that I should make an appointment with the US Embassy in London on my return. This I did, and completed a B2 visa request. It was declined.

    With hindsight, I acknowledge I was spending more time in the US than the UK (so, a part-time resident), but was unaware of this restriction. I always stayed at the same address, was able to fund myself, and had adequate travel insurance.

    If I were to travel to the US again in May, under the VWP (I also still hold a valid ESTA), for a 2 week stay, would the fact I was declined a B2 visa in any way lead to an entry refusal at Immigration?

    The same issues that triggered the denial of the B2 visa remain in play, and thus could cause an immigration officer to deny you entry under the visa waiver program. It would be safer to enter with a visa; if you continue to be denied you can expect that the result would be the same at the border, but without your investment in a plane ticket.

    Thanks for your reply Mr Knowitall.

    I am waiting to be in a position to apply for a K1 visa, although this will not be possible for some months. Would you consider it foolish for me to take a short vacation in Canada and then take a train to the US, and to take my chances at the border?

    Additionally, will having been denied a B2 visa affect my K1 application in any way?
