My question involves a roommate in the State of: Texas
Last summer I had told my roommate I would like to move out, things were not working between her and I. She agreed. A few months later I finally moved out when her friend was able to move in to take my place. In Texas the new roommate and current roommate have to go fill out applications stating she's living there now. I am only allowed to get off the lease after they have done so. Before moving out my roommate assured me they would do so. Weeks turned into monthes.. I had let my apartment know I was no longer living there. Gave them the name of the girl who took my spot. I would call up to the apartments about once a week to see if they had ever gone down and filled out the application, so I could come in and sign my part. Never did. The apartment said legally all they could do is fine my old roommate for not adding the girl living there to the lease.
Ok, so about a year later, I'm checking out my credit report. There is a 600 dollar move-out fee on there, from having to replace carpet, countertops, cleaning etc. (Reason I couldn't live with her)
Legally what are my rights? Should I take her to small claims, sue her? I've got witnesses stating when I moved out, also am pretty sure the apartment would have record of me going to their office letting them know I no longer lived there.
