My question involves a child custody case from the State of: Kentucky and Ohio
My two nephew have been living with my husband and I sence July of last year. My sister decide to go to rehab on Jan of 2010. When she entered rehab she gave my temp custody of both childern until she gets out. The Father of both childern only calls once in a blue moon and tells him he will come and get them on the weekend and then never shows up. So while my sister was home on visit last weekend she gave the oldest son his mothers phone number. He called his grandma and talked to his dad. The Father showed up at my house today wanting to take them out to lunch. I said no because you do drugs and I don't want the childern around that. He said he has been sober for a while now. I told him I didn't think I could believe him, because the last time he told me that he was on methodome (spelling?). Him and his wife have been taking the methodome off and on for two years now trying to get of heroin. His reply was he was perscrided that by a doctor. Well my sister was perscrided the pain meds she was addicted to and she is in rehab right now. Anyways, He preceeds to tell me he has full custody of the oldest child and he will bring the cops and the paper work with him Monday. I talked to my sister tonight she did say she gave him full custody of the oldest child 2 years ago when he wanted to go live with his dad in Ohio.
My question is can he take the childern if I have temp custody of both childern? Even if he hasn't seen them or help pay for anything. Also I'm the on who enrolled them in school and got them going to see a consuler. The oldest on is involed in school activites. And the youngest one is making great progress and loves school. What can I do to prevent this from happening? If the Father and Step Mom were not on drugs and had a stable home for them I think they should be with them while my sister is in rehab. But the don't have a good and stable enviorment for them. I have lived in the same house for 10 years and have same phone number for 10 years. It's also in the phone book. So he has no excuses as far as I'm concerned. He didn't even call them on Christmas or thier birthdays. We live in Kentucky he lives in Ohio thats why the full custody is in ohio I guess. Please help!!!
