    Default How Do I Collect Funds from a Judgement

    A judgement was ruled in my favor in a small claims case where the defendant owes me $1000 (in Virginia). I have no way of collecting since I do not have his social security number. I wanted to garnish wages or intercept tax returns but I was told by the court clerk that I must have his SSN. With the privacy act and other laws, how do you obtain this? What other things can I do to collect my money? And the worst part is I see the defendant every day and he taunts me by saying he will pay me when Hell freezes over. PLEASE HELP ME!!

    Either you need to learn the procedure, or you need to hire an attorney to issue a subpeona and require the debtor to show up for a deposition along with all his financial records which you can review. It is then that you get his SS number, his bank account numbers, where he works, find out his assets, etc.

    Of have him followed and find out where he works and banks and then garnish his wages and seize his bank account up to the amount of the judgment. Either you need to learn how to do that or hire an attorney to do it for you. You can actually seize the contents of his bank accounts once a month until the judgment is paid. That will be lots of fun for him when his checks are bouncing, etc. His tune will change real fast.

    You can inquire with the court about holding a creditor's exam, where you subpoena the debtor and examine him under oath to obtain information about him and his assets.

    OK I believe this is the same. Notice to Debtor. So I can request his SSN while he is under oath? Is there any other questions that I should asK? Thank you AAron..That is a huge relief for me..

    You should sit down and write up a list of questions that will cover all possible assets, real and personal, investments, 401k, bank accounts, cash on hand, judgments he owns, any contest or lottery winnings, etc.
