If you have proof that her husband wasn't your father, you can go down to the court house and file to have it amended.
I'm going to tell you now though - your receiving your real father's VA benefits isn't going to be enough to convince the courts (as stepchildren can also benefit).
I don't have any proof that he's not my father. How can I obtain that info? I've never met the guy and mom's not any help. She never married my real father, since she was going through the divorce when he passed away. So, since she never married him, would I still be considered a step child and receive the VA benefits? I do know that he did some paperwork through the VA stating he was my father. Would they have anything that could help? It's not that important to have my actual father on the birth certificate. I really just want my mothers ex removed. I would be okay with father unknown, if nothing else. Also, thanks for the reply.
