My question involves criminal law for the state of: Florida
Age:19
Crime: Petty Larceny, 1st offense
Amount: Under $50
Location: Walmart
Prior Record: None
* I have a good community record (volunteering, church, etc)
Situation Surrounding the case: was pressured by bad friends to take trading cards and was caught and fingerprinted. Have accepted pre trial diversion at this point.
No civil charges are being pressed.
My question is, is it possible to get a dismissal if I take this case to court. I have been having a rough few months and the pre trial diversion program is becoming too much for me to handle being a full time student and full time employee, living away from my parents and paying rent. Not only is the program outrageously expensive considering the nature of my offense and the amount of money that was involved, but I have been advised by many lawyers that a dismissal is likely if I take my case to court and plead my case. I am a good, hard working kid, and if I have to do some more community service I am okay with that. The fees and the program however are becoming too much for me. Can I just take this case to court and plead my case?
