    Default Foreclosure Clock

    My question involves bankruptcy in the state of: Washington.

    Greetings. We filed Chapter 7 in early December. The discharge should be coming shortly. We reaffirmed our primary Mortgage and our 2nd which is a heloc. We were current with mortgage payments until after we filed. Since December we have not made a payment. We are in arrears December, January and February. Likely, we will not make March's either. Does the foreclosure "clock" begin after discharge, or during the banruptcy process? Should I expect a letter as soon as discharge is done from the primary lender indicating foreclosure proceedings are in the works, or is there a delay after discharge? Just want to know what to expect.

    Depending on the lender, since you haven't made a payment in a few months you are probably already in their crosshairs. Since the debt was reaffirmed and you are responsible to pay it I don't believe they have to abide by the automatic stay. It's just a matter of time and someone will be in contact with you.
