    Default Concealment at Walmart

    My question involves criminal law for the state of: North Carolina

    In North Carolina, simply placing an item in a pocket constitutes a form of shoplifting. Recently, my son was caught concealing merchandise at Walmart and hadn't even had the opportunity to pay for the merchandise he had placed in his pocket in order to put his jacket on. It is against the law and I understand that. My question is does he have to pay Olonoff, Asen & Serebro (Walmart's law firm for dealing with civil fines) $150? Will Walmart take further action? He has settled with the State on the charges. Our attorney told us he wouldn't pay the civil fines and Walmart usually doesn't do anything other than threaten further action.

    Your attorney is asking you to gamble. If you do not pay, the amount increases and the retailer very may well file a civil suit if you do not respond. If they secure a judgment against you it will have a direct affect on your credit.

    Most people in your position think that this unfair, but it's a fact of life and the law. I can tell you for certain, the $150.00 will turn into much more if you ignore it. If your thinking it will cost WalMart more to collect than it's worth to them - the civil filing fee is about $15 - $20 in many civil courts and they do not need an attorney to file. WalMart has a reputation for following through with Civil Demands. Again, you takes your chances.
