Hello Everyone... I am trying to get my mother back into the United States. I am a citizen of the U.S. and over 21 now so I am trying to petition for my mother, but my mother has a record of 20.03 Criminal possession of a controlled substance in the seventh degree which she got about 22 years ago.
I don't want to spend the money on the application and be denied due to her record. This is why I am trying to see if there is any sort of pardon or anything I can do to get this record expunged in the State of New York.
She currently is living in her country of citizenship.. but 22 years ago my mother was charged for 20.03, but never deported because she was acquiring her resident papers at that time. A couple of months later...my father passed away from a car accident and she never got her resident papers situated. She also knew little English and the drugs were not even hers, they belonged to my fathers cousin, but she was present when they searched the apartment and was told by the lawyer that helped her to plead guilty and the process would be faster. Needless to say, it gave her a permanent record and I want to petition for her, but I am not sure where to start. Hiring a lawyer at this point would be wonderful, but I do not have enough funds to do so.![]()
