About 20 years ago I changed my name by common law. I have a notarized document that shows the change from my birth name to my current name. At that time I changed everything DL, SSN, etc. I have only worked under my current name. After moving from another state I tried to get a new DL but a passport or birth certificate is required now. I have decided to go to court to get a court ordered change of name (since this can only get more complicated without one).
My question is, the only document I have in my birth name is my birth certificate, no ID or an old SSN. All of my ID is in my current name and my notarized declaration of name change form contains both names. Will I have a problem filing the forms with the court to get a legal name change?
I am afraid they will require ID in my birth name and I am remiss to try and get ID in that name because that would be illegal (I believe). So on the forms I intend to file I have (as the petitioner)

I have been doing so much research to find someone with my problem and can't find an answer. I did however find information about a name affidavit that basically says that under penalty of perjury that my BirthName and CurrentName are one and the same person, then you put your SSN on the form as well and have it notarized under oath. Could using this form help me? Or is that just extra work for no reason.
I have not attempted to file my forms yet. Is there any advice you can give? I would really like to get this cleared up. I am trying to file the forms myself and cannot afford a lawyer.
I would also like to say to anyone reading my post, if you have any issues with your legal name (birth name) or if you have changed your name by common law or by usage as it is sometimes called, I would suggest fixing it. Change your name through the court system. From my experience this is a nightmare.
