In September of 2008 I travelled down to Australia on a working holiday visa and stayed until August of 2009. I explain this because in February of 2009 I met my girlfriend who is an Australian citizen, we are going strong and she was scheduled to get up here the beginning of 2010. Not knowing how much trouble it was going to be she applied for the B1/B2 Visa so that we could have more time together than the 3 months that the Visa Wavier Program allows. She applied for 6 months and was originally postponed because she needed more money, so she obtained some more money and tried again. Then they told her that she needed more proof of her return to Australia and asked to see official letters from her work stating that she will still have a job upon her return to Australia, so she got those as well. Everything looked like it was going to workout, but then they denied her, for one of the most idiotic reasons I've ever heard, because she has a boyfriend in the US (me). I may not know much about the legal system but personally that is stupid as heck, how can that seriously be a good reason to deny a visa? Now that she's been denied we've been told that she can not apply for the Visa Wavier program and her name has been flagged. How am I supposed to see my girlfriend and not even just see her, because I realise I could fly there, but we had plans to see things in America such as Disneyland, good parts of LA and other places known to people living outside of the US. I understand that we could apply for the K1 visa but we were hopping to at least get to spend some time together before we tied the knot. Also now that she's been denied, for this idiotic reason, I have lost all faith in our immigration system, what happens when we try prove our relationship and everything else for a K1 and they deny us because there is no record of her coming to the US to visit me, this hasn't happened yet, but then again we haven't applied for one yet. PLEASE HELP it feels like we've almost run out of options and both of us are missing each other like crazy, especially because before all of this happened she already had a plane flight over here and now because of this she was forced to give up her ticket. We are just two normal people who fell in love and want to be together and see the world and get married on our time rather than being forced to just to see each other. please help with any advise possible, thank you.
