    Default Agreed to Purchase a Boat by Email, but Seller Sold to Someone Else

    My question involves personal property located in the State of: Kentucky.

    a boat on Craigs list that I was interested. I contacted the seller and I offered him $1200 for the boat he was asking $1350 and he accepted the offer. This was on Tuesday with me picking up the boat on Friday evening. He sold the boat to someone else on Thursday evening, after I emailed him asking for his address so I could pick it up the next day for the $1200. He never contacted me or anything before he sold it.

    I have the agreement to sell the boat to me in email. Is there anything I can do? I would have picked it up Tuesday but it was 4 hours away on the route that I drive home on Fridays

    If you locate and purchase a truly equivalent boat (same model, year, condition, etc.) and end up paying more than $1,200, you can try suing the seller for the difference in the price. I can't promise that a court will award the difference - even if you could find such a boat, odds are there are going to be some differences that the seller could point to as triggering the difference in price. You could try suing based on advertised price but, as your own scenario indicates, advertised prices and selling prices can be quite different - and it will be even harder to prove that the advertised boat is effectively identical to the seller's boat.
