    Default Slipped Fell Down Stairs Due to No Snow Removal

    My question involves an injury that occurred in the state of: Ohio
    Tues. evening as i was leaving for work about 9:30 pm i fell down the outside stairs at my apartment building. They had not removed any snow or ice from the last 2 storms we had (nor plowed the parking lot). this is a big apartment complex approx 16 buildings with 12 apartments in each. I ended up having to take a day and a half off work and ended up at the hospital earlier today (weds.) Now i took pictures of the walk way with all the snow and ice approx 12 hours after it happened, pictures at night don't turn out so well so i took them early the next morning. Now my questions are: what are my options? I have never had this happen before so I'm not sure what i should do. i have not contacted the management as of yet. What do i do?

    I know that's not the info you're after, but hope it does help a little.

    I would contact the apartment management and advise them of the situation.

    There are a number of issues here.

    If you are talking about last week's storms, in my area NY, the storm hit late Tuesday, and lasted to early Wendesday morning, after midnight. In most municipalities, management is given to certain period of time "after the cessation of the storm" to clear off the sidewalks and walkways.

    Here in NY, the storm lasted all the way to last Tuesday night, after midnight, and my wife went out to shovel at 7:00PM, and I insisted she come back in because of the danger of shoveling "in the middle of the storm", plus additional accumulations. Although the storm passed the area on Tuesday midnight, it is not required to clear the snow till 11:00AM the following morning.

    In fact, she salted the steps on the front porch late Tuesday night, and it was all under several inches of snow Wednesday morning, so it turned out to be a total waste of time and money.

    If I was management, I would not have my crew start the work in the middle of the storm, late at night, but wait till the morning where workers can see what they are doing. It would place the workers in "extreme peril" to accomodate the few that has to leave for work late at night, not to mention a colossal waste of time and money.

    Further, you should have notified building management immediately.

    If management hired outside contractors to clean the snow, as I have some years back for a property far away from me, one crew who tried to come in the middle of the storm got stuck because the local streets were not plowed, and afterwards, only come after the cessation of the storm, and street cleaning.

    Bottom line is, it is not clear at all that you can establish a clear case of negligience here.
