My question involves a traffic ticket from the state of: North Carolina
I was pulled for failing to move completely over as I passed a police cruiser that was behind an abandonned vehicle on the shoulder. The place I passed the cop was where there is a 15' shoulder and part of his vihicle was of the shoulder. The law requires the vehicle be within 12' of the roadway and also have his lights or siren on, which were not. I have contacted a local attorney who told me that i do not have a right of discovery. I wanted a copy of the cruiser cam to prove my side of the event. Is this correct? Can the evidence against me be omitted when it could exonerate me? i have three witness's that have agreed to come to court and testify but the cruiser cam was my golden ticket. What is the chance that the cruiser cam video will no longer exist by the time I get to court? Do the police erase these tapes? Can a judge ask to see it? If the tape doesn't exist do I stand a chance in court against the word of an officer with three witness's? I live 300 miles in SC from where I got the ticket so it is difficult to make the arrangements.
