    Default How Many Court Decisions Are Successfully Appealed

    My question involves court procedures for the state of: California

    Does anyone know, or have a guess about, what percentage of court decisions are successfully appealed? By successful, I mean having the judgment reduced or totally thrown out.

    A group of non-lawyers (including me) are discussing whether Half Moon Bay, California should have filed an appeal in a court ruling that went against it in a land-use case. People who are unhappy with the decision act like they're pretty sure the ruling would be overturned on appeal, but I'm not so sure.

    That's impossible to answer.

    Seriously. Even "similar" case-law will contain unique elements.

    Wow, that was a quick answer. Thanks Dogmatique.

    Can I ask, though, whether you were saying that it was impossible to guess at the percentage of successful appeals, or whether you were referring to the probable success of appealing the HMB case? I can understand about not being able to predict the outcome of the HMB case, but is it impossible to say something like," Generally, only 1/3 of appeals are successful"?

    BTW - my legal training consists of a business law class I took at UC Berkeley, so there easily could be some legal subtleties I'm missing.
