    Wink Ramifications of 5th DUI and Felony Cocaine Possession

    My question involves criminal law for the state of:
    California

    My fiancee is moving here from Wisconsin to marry me on Feb 20, 2010. From perusing other forums, I am under the impression that a marriage license and a letter of intent to support him and provide a place to live will enable him to transfer probation from Wi to Ca. immediately, assuming it is ok with his probation officer and California accepts him. What are the real ramifications of these offenses? His drivers license was revoked for 2 years, until 2011, and his probation extends for 5 years. How soon can he get a Ca drivers license to be able to work? He gave up alcoholism while imprisoned for the 5th offense, by the way, and became an active AA member who attends church regularly. Should he just not drive for 7 years until it drops off his DMV record and allows ins coverage to normalize? Does getting a California ID allow him to still get a job ? Don't employers just want a valid drivers license to be sure that one is not an illegal alien?

    If he's suspended for two more years, you should expect that it will be at least that long before he gets a driver's license. He may at some point qualify for a restricted license. One of the consequences of repeated drunk driving is that you may have to make arrangements to get to work other than by driving yourself.

    If a job requires driving, it's reasonable to expect that they'll want to see a valid driver's license. I am not aware of employers asking for driver's license as proof of lawful status to work in the country.

    You ask on the Sunday before your wedding if he can legally live with you?

    I was going to ask you to reconsider, but that doesn't appear to be a huge deal for you.

    California stopped handing out ID cards to undocumented people years ago. If the job dosen't involve driving, an ID card will suffice as official ID. Employers usually require two items to identify youself, a social security card and a valid, govt issued ID.

    If he does get a license, keep in mind during his probation for DUI, he can be tested for BAC, any measuarable BAC level will result in his vehicle being towed and he can possibly go to jail. Not to mention, I'm sure the insurance rates will be sky high if he has 5 priors (I'm sure you allready know that). Living in a place with a good public transportation system would be ideal until his DUI's fall off unless you drive him everywhere.

    One last note, if a bicycle is his choice of getting around, make sure it has all the proper reflectors and lights at night.

    Thanks for all of your input. He doesn't drive and gets around pretty easily on public transportation. We both understand the consequences of his driving convictions and will wait out the insurance rate interval. I live in an industrial section of Mission Valley so he will be attempting to work a diesel fleet mechanic job here in the neighborhood.

    He is carrying back our marriage license copy and a letter of intent for me to support him and have a place in California for him to live-how long does California take to transfer probation?

    He cannot do anything in regards to his driving privilege until his license is eligible to be reinstated, once eligible he needs to contact WI DMV.
    Even though he is not living in WI anymore, he may need to apply for reinstatement in WI first, once reinstated he could transfer his dl.
