My question involves criminal law for the state of: California
Someone threw a hammer through my car window while I was in it. The attack was unprovoked. I know who through the hammer through my window. I was there, and I have a witness who was also there. The vandal was the roommate of my witness.
The vandal called me on my Verizone cell phone and left a message gloating about what he did. Sadly, I didn't store the message before it was deleted off of my saved calls.
I called Verizon and they told me that they did indeed keep those records for a period of time, but I would have to subpeona the company if they were going to release the records to me.
I need to subpeona Verizon (cheaply) and get the recording. I also need to get a statement from the witness so I can press criminal and civil charges against the vandal.

Does anyone know if this is the correct form to do what I'm trying to do? I can't afford to hire a lawyer. It's not worth it for only a window.
I have not yet filed criminal charges, but I did file a civil suit although I couldn't serve the papers because the vandal avoided the sheriff who was serving them for me. My witness is also flakey and may not give me a written statement unless I put the screws to them.
