Im in Texas and 3 months ago purchased a home,with a HOA. Brought roadbase in at a cost of $600 due to flooding in the driveway.Immediately the neighbor across the street threw a fit.He said I HAD to dig a trench between the street and my driveway because the water would come down and flood his yard. There are culverts on both sides of the street,mine and his. I refused,my driveway is not different from any other in the subdivision they all go from the street on back,even his. Now,I admit that when it rains the water does flow across the street to his property.The problem however does not come from my yard but the person right next to me.At the corner it pools up and goes across the street. Well while I was gone for 3 days the neighbor across the street came onto my property and dug a trench between my driveway and the street all the way across to my culvert. Now some of my roadbase is washing into the culvert. I have no tresspassing signs,I called the sherriffs office and was told it was a civil matter. I called and left a message with the HOA,emailed them,no response yet. Im at my wits end and wonder what options do I have?
