    Default Insurance Co. Refuses to Cooperate

    My question involves insurance law for the state of: PA

    I recently had a psycho neighbor damage my car. She poured some kind of substance into the gas tank causing all kinds of damage. Almost $4000.00. I had the mechanic do lab work to prove their was indeed malicious intent, & confirms a substance was poured into the fuel tank. I reported the situation to the police, & they filed a report.

    My insurance company sent out an investigator, & the claimed they found evidence that what I "claimed" was not the truth, & that I was somehow responsible for the damage to my car.

    The insurance company will not cooperate with me, & will not even call me back. I want a copy of the report, but they refuse. 60 calls later & NOTHING.

    I need help & advice.

    did you make a claim on your insurance?

    do you have any proof the neighbor did it?

    We did make the claim, but they sent an investigator out after the claim. We do not have proof the neighbor did it, but we had lab reports done to prove that someone stuck something into the car to hurt it. The insurance company will not even call us back.

    Can we sue? Subpoena records, etc... Take it to small claims?

    as long as the damage is covered under your insurance policy, yes, you can sue. Most states have a state office for regulation of insurance providers. I did not check if yours in fact does but that should be your first step.

    then, reading your insurance policy would be a very good idea. You may be bound to certain actions against your own carrier such as arbitration.

    if not bound by such limitations, then sue if you haven't gotten any results.


    small claims? not sure. Check with your courts directions as to what is allowed in SCC. I would think it would be allowed but not sure.
