    Default Juvenile Arrest Question

    Thank you for your responses, in advance. When I was 17 I was caught shoplifting in a mall (I am now an adult). Mall security stopped me and took my information. They allowed me to go home within 10 minutes (we did not leave the store in which the incident happened) and my parents were not notified and I did not see a police officer. My question is, do I have a criminal record?

    The security officer stated that the store could have said that they wanted charges filed. I have never received any court documents, summons to court, gone to court, etc.

    I did a state criminal records search (through the state court system) and no record was found (but I guess no record would come up since this is a juvenile issue). I contacted the juvenile services unit of the state and was told that juvenile records are sealed and can't be released to anyone. I am not sure who else I should check with regarding a record check. I will be applying for a professional license and don't know what to do.

    Given the facts you have described, no, you do not have a criminal record in relation to that incident. It doesn't even sound like a police report was filed.

    Stupid question, but... I can truthfully answer that I have never been convicted, pled guilty, pled no lo contendre, entered a pre-trial diversion program, been arrested, been cited, etc., correct?

    It is probably also a stupid question, but I would have knowledge if any of the above occured, correct?

    Just trying to cover all of the bases.

    Aaron,

    Thank you very much for your help and quick responses.

    The police report you mentioned, what would be the purpose of this? I would assume that it would be a precursor to a criminal charge?

    The store expressed that they would not be filing charges, thus meaning they would not be filing a police report?

    Also, my parents would be notified of any of those actions, correct?

    Would I be notified if there was a police report filed naming be as (I don't know the term) aggravator(?) ?

    The purpose of reporting a crime to the police is to have the situation reviewed for possible criminal investigation and charges. When a crime is reported to the police, they ordinarily create a police report.

    There are people who, after being assured by a store that no charges will be filed, discover that the police were notified and that they are being prosecuted. So the store's promise doesn't mean much. The fact that you were never contacted by the police suggests that the store did not contact the police.

    Suspect. Had a report been made, ordinarily the police would have contacted you to take a statement, and (whether or not you gave a statement) would have forwarded the report to a prosecutor to review for possible criminal charges.
