    Default Can Approved Asylum Get Green Card Through Marriage to U.S. Citizen

    I have a friend. He was just approved for political asylum. He enter US without visa. He married to US Citizen a few years ago. I know he can wait for one year and apply for I-485 based on asylee. But can his wife file I-130 and he file I-485 at the same time based on marriage to US Citizen?

    My concern for your filing an I-485 would be that he initially entered the country illegally. That can be overcome if he adjusts status as an asylee, but is not erased by an I-485 filed by you on the basis of marriage.
