    Default Photo Posting on Facebook

    While on a cruise, my ex took photos of me and subsequently gave them to me on a flash drive. Would I be prohibited from posting these photos on facebook because, as the photographer, she retains intellectual property rights?

    Conversely, I took photos of my ex with her camera. She would not give me these photos but I later discovered them posted on facebook. As the photographer, do I have intellectual property rights for these photos and can I copy them and repost them elsewhere?

    I could have been deceptive about the circumstances but I opted for an accurate, honest disclosure instead. I was hoping for an accurate, honest discussion of the legal issues.

    While in the strictest sense, each of you retains copyright control over the photographs you've each taken, the fact is, there are few copyright lawsuits brought forth over snapshots.

    It's hard enough to prosecute them when there are actual monetary damages involved, nearly impossible when they aren't.

    If she objects to you posting photos that she took (or vice versa), the upset party could complain to Facebook and have the photos removed. But that's about the extent of it.
