    Default Unpaid Tuition by Sponsor

    My boyfriend was a sponsored student at a US college, the college got paid when the bills were properly sent to the foreign sponsor. Two years after he completed his degree he received a notice of unpaid tuition balance from the college. The college stamped his papers as 'paid' every semester during registration, and never notified him that there was any unpaid balance while he was student.
    He never signed any paper stating he will pay his tuition. Now the college threatens to sue him if its not paid in full. He understands that he got benefits but never assume he will be the responsible one for the tuition. The sponsor says its too late for making any payments now since its been more than 10 years.
    My questions:
    1-What can be their legal arguments/claims for going to the court since he never had any papers signed with the college?
    2- How successful they can be at their claims?
    3- Is there any statue of limitations for unpaid tuition?

    As you were told when you posted, laws are different in each state. So how about belatedly telling us where this occurred, so we can try to address the governing laws?

    If it has been ten years since graduation, odds are the statute of limitations has run.

    Thank you for the response. He graduated in 2000 from a state college in Ohio.
    The unpaid tuition is from 1997 to 1999.They informed him about the unpaid tuition in 2001. Its really sad that it will take them this long to figure out the unpaid college tuition. Now they don't give him any options but either pay the amount or face the court.
    He tried to reach them but they haven't been responsive to resolve this matter.

    1-Will it matter if its a state/public college for the statute of limitations?
    2-I know the college chooses the easy way out and comes after him since he resides in the states, but don't they have to show some sort of contract or a document for their claims? He offered them a considerable amount to settle this since the court will cost him as well. But they did not accept the offer. Did he make mistake for trying to settle this matter?

    A state school may well be exempt from the statute of limitations, as explained here.

    If there's no contract between the student and the university obligating the student to pay, the student can attempt to use that as a defense if sued. It's possible that the court would nonetheless award damages on the basis of quantum meruit.

    It is really sad that the college did not act timely on collecting the tuition from the sponsor. I understand the college should get paid for the benefits they provided but its also unfair to pay for someone else negligence.
