    Exclamation Guests Limited on Verbal Agreement. What Happens if I Violate This

    I've asked quite a few questions on here about my current situation, i'm renting a room/ shared use of common space and a bathroom, from two brothers who are on a written lease with the landlord (owner) of the building in New Jersey.

    our original verbal agreement, was that my boyfriend can stay over (days and overnights) 1-2 days per week, in fact all we said was "he can come over as long as he doesn't become our fourth roommate"

    this coming weekend, my boyfriend is planning to come by saturday and sunday (which is the two days allowed by verbal agreement) to help me pack, and run some errands, etc. my mother and sister will also be visiting on sunday to help me pack. ( ive given my thirty days notice to be out by march 1st already)

    my roommates have been verbally and in writing via email threatening me with lockout, keeping deposit, increase rent, threatened physical removal of myself and of my boyfriend if he is in our apt more than the 2 days per week. ive called the police who have told me that regardless of verbal agreement as a paying tenant i have a right to have guests, and the removal cannot be enforced by the police, they can ask my boyfriend to leave voluntarily and he can say no, that is all that can be done. the officer also stated that any verbal or written threats count as harassment, and i can press charges for that.

    Until today, i had no interest in violating the verbal agreement of 2 days, because i'm not interested in causing issues, but this weekend new jersey is supposed to be hit with a blizzard,and in the instance that my boyfriend has to stay into monday (third day this week) do my roommates (who are technically also my landlords) have any legal ability to have him removed? or is this simply me breaking our verbal agreement ( in which i can tell them to take me to court for that, though ive already given thirty days notice)? i am absolutely SURE my roommates will not be lenient on the 2 days per week term.

    the police officer i spoke to said that they could not and would not do anything to remove a guest, as long as one tenant wanted them in the home. but should a different officer come by who thinks otherwise, or should my roommates physically remove him from the house... what are my rights?

    No matter which officer arrives, the situation remains the same: it is a CIVIL matter, and police aren't going to get involved unless there is some reason to believe that a crime has been committed. Police will tell the roommates that are unhappy to go to court and ask for either an eviction on you (for violation of the agreement) or a restraining order against your BF (if they can make a case that they have some reason to be in fear of him). Honestly, their chances of getting either are pretty slim. Since you are living under the roof, you have legal rights as a tenant (and even Judge Judy with PMS understands that BLIZZARDS happen). Tell your roomies to either get over it, or waste some time and money taking you to court so they can hear a judge tell them that filing suit because a BF stayed an extra night during a blizzard is a stupid waste of the court's time.
