My question involves child support in the State of: Kentucky
In the state of Kentucky, who is permitted to forgive a noncustodial parent's child support arrears? Is it solely up to the custodial parent or is it either the custodial parent or the court system? If the court system is permitted to forgive child support arrears, in what cases would they do so?
To give you a background on my question, the father of my fiancee's daughter is $2,900 behind in child support and has handwritten a letter to the court system asking that his child support obligation be reduce and his arrears be cleared because he quit his job back in June 2009 (he accepted a $100,000 buyout from Ford and did not pay a single child support payment with it; and no, he doesn't have a penny of it left). He also stated he was in destitute circumstances because he is currently working temporary jobs through a staffing agency, lives with his parents, and cannot pay the obligated $725/month in child support.
