My question involves landlord-tenant law in the State of: California.
On Feb. 1st I collected Feb. 2010 rent from tenant and hand delivered a 60 day notice to terminate tenancy for a month to month residential tenancy. My notice indicated to contact me 2 weeks before their final move date so I could do a preliminary inspection.
On Feb. 3rd tenant calls me and says he is moving out on Feb. 15th and wants 1/2 his Feb. rent back. I told him that he had to give me a written30 day notice to terminate tenancy and would not get 1/2 his rent back. Am I correct? Can tenant take me to small claims court for this?
What should I do about a preliminary or final inspections?
