    Default Simple Assault Case

    My ex girlfriend and me kind of got into an argument at the university.
    We had actually taken some sensitive pictures of each other and that's how the argument actually started as I had some papers in my hands and she assumed that they were the pictures and that I was showing them around to people. Thus, she started groppling and grabbing and pushing and stuff, and I guess we got a little loud and someone called the police. During the argument, she actually picked up a 2x4 plank and tried to hit me but I grabbed the other end and swung it, So the end she was holding got out of her hand and hit her body after which I left as it was really getting out of hand and she was screaming very loud. Later on I got a call from the university police and they gave me a citation for a assault case. I read the statement and it says that she told them that I had actually picked up the plank and hit her and supposedly she has pictures of the bruise that she got from that, and plus it says that there is one witness. I recognize the witness and it's actually one of her friends. But I know for sure that no on saw our fight , as we were in a room (someone might have heard us arguing, but I know for sure no one saw us hitting each other), but in the report it says that the witness advised the cops that I hit her, with the 2x4 plank. Can you please give me advice on this. I have pre-trial hearing conferrence (whatever that is) in June for this case.
    How much jail-time can I get for this? is there an alternative like a fine or something? I really don't want to go to jail for something I didn't do. But I am afraid I will lose as there is a witness on her side even though I know he is lying that he actually saw us hitting each other.

    The most common outcome for a first conviction simple assault case is probation, with fines and possibly community service. You should consult a lawyer given that you claim to be falsely accused, and given that sometimes it is possible to resolve a charge like this without getting a criminal conviction.
