    Default Abuse of Police Records

    recently I wrote about how my ex never returned my daughter after his parenting time on New Years. Now I have her back, thanks to the court. However I have a question:

    My ex is a reserve police officer. SHould I let the department where he works know about what he has done? I don't think he should be a police officer, and it's also obvious he uses his position to access my personal records - for instance, he had detailed police reports of a time when I was raped - how would he get this? I've never told him about it. He also had an old PPO I had against an ex - really old, which has been long terminated.

    Is it illegal for him to use his police pass to access my records for our personal matters?

    Also, his brother is his employer, and has always paid for his legal support regarding our daughter - his brother has some kind of interest in this which I am unaware. However, after the kidnapping and being shot down for custody (again) my ex will never have a leg to stand on in the future. Anwyay, his bro has not been properly paying me child support - for instance, when he kidnapped my daughter, he just stopped paying me. He is now in arrears. How can I remedy this?

    You can tell them. They typically will smile and say "thank you" and forget all about it. Unless he was actually charged with a crime (which he wasn't since this was a civil matter), they are going to write it off to the typical evils and accusations that accompany custody battles.

    Police reports and court transcripts (unless sealed by the court) regarding closed incidents/investigations are public record. Anyone who knows an address can get a history of everything that's happened there, or if they know a name, they can get copies of reports filed by a person, or against a person, etc.

    Very much so. If he wants that type of information on you, he'd have to go through the same channels as anyone else - making a request for the records, paying for copies, and receiving only that information that would be made available to anyone else asking for such records, etc. If you have reason to suspect that his police access to such information has been abused, it's time to call the department and ask to speak to a supervisor about your concerns. They should be able to investigate if improper usage of several different systems occurred (for example, seeing if a query on your name was run from his account). This type of activity is VERY serious.

    You notify the court that the payments are not being made as ordered.
