    Default Traffic Court Date 2 Years After Requested

    My question involves traffic court in the State of: Texas

    I received a speeding ticket for doing 34 in a school zone in early 2008. It was a speed trap and the school zone lights were not flashing AND I believe it was a holiday week so kids were not in school (my recollection is a little fuzzy). I promptly sent the ticket in to request a court date the day I received the ticket. I didn't receive a court date and soon forgot about it until I received a notice scheduling the court date for August 2010. I know there's no statute of limitations for traffic violations but since speeding tickets are considered misdemeanors in Texas, don't speedy trial rights apply? It's likely the ticket will be dismissed b/c the officer doesn't show up but I'm really puzzled about what recourse I would have if he did appear.

    Also, I don't know if it matters but the ticket was issued by a deputy constable for Dallas County and not the city itself.

    I'd appreciate any guidance anyone can offer.

    depending on what actions the state has taken in the interim and whether you moved residence, there may be no time defense but if the state has no explanation for the time lapse, I believe you would have a legit defense.



    So, have you moved at all during the interim?


    and with just a quick look, I found one source that states a misdemeanor with no more than 180 days in jail, or a fine only has a 60 day time limit to be within the right to a speedy trial for Texas.

    I have not moved at all. I also found the same information you referenced about the 60 day time frame. The only reason for the delay that I know of was something about their computer system that I read about in our local paper a long time ago. Thanks for responding
