I'm not sure. It depends on the store's policy. If the items were returned and undamaged, they probably may let it go. Then again, that was from a thread from a month ago. All I can say is expect a civil demand letter in your mailbox and pay it as soon as possible.
Most states allow retailers to collect Civil Demand even if the merchandise is recovered.

You BOTH will likely receive Civil Demands, which are separate from the Criminal Charges.
Pay those immediately. The judge in my case liked to see that the C.D. was paid, so my lawyer instructed me to bring proof of payment to court.
Even though the store has the merchandise, they still have costs associated with your shoplifting, and the people who got away with it.
- The store has to pay their L.P. workers.
- Those surveillance cameras don't come cheap.
- The shoplifters that got away - this affects how much a store can afford to pay their workers. Some of the loss is also tacked onto those price tags.
- The store has a Legal Team. They have people who mail out the demands and make sure they are paid.
- Stores lose BILLIONS of dollars per year because of shoplifting.
- Basically, you get caught shoplifting...a lot of these costs are given to YOU via the Civil Demand.
