    Default Returning Via Citizen Sister

    Hello, I'm new to this forum and I had a question about my situation. My mother, my father, and I were forced to leave the US in September 09. We were told that we had a 10 year ban. My sister, a US born citizen remained in the states to continue school. I know that she can petition for us once she turns 21. She is 17 now so we have a while to go. My question is once she is able to and file for us will we still have to wait out the remainder of the ban or will processing times run concurrently for both the ban and the petition? And would we have to file the I-212? And what are the possibilities of her petitions being approved?

    Thank you for your reply. I was deported and banned because we lost a case hardship case via my sister and were given the option of voluntary departure. After which our lawyer informed us we could appeal. The application was sent but arrived late and therefore got denied so we were caught in an overstay situation. We filed once more for the appeal and after time got denied again. During this process ICE arrived at our home and was going to deport all my family (except my sister). They took me and my dad, but after some help from the university (which I was attending) me and my mother were given an order of supervision while I finished school at which time we left voluntarily. We were still handed the forms like my father that stated we had a 10 year ban for overstaying. I hope that answers your question. Thanks for your time and replies.

    By the time your sister is old enough to petition for your return, an I-212 waiver will no longer be necessary.

    Generally, the ban and petition times can run concurrently. You'll want to check with an attorney in your area when your sister is of age to petition for you - immigration laws change with some frequency, and what is the correct answer today may not be so in four years.
