    Question Emancipation

    My state is: Mississippi

    OK, So I have planned to get emancipated for a about 2 years now. I am 15 and I live in Mississippi. The legal age to get emancipated here is 16, and the maturity age here 21. About 2 weeks ago, I sued state farm for a car wreck because the air bags DIDN'T deploy and they settled for a little over $50,000. My lawyer will get about %10 and I will get the rest put into a savings account until I turn 21. Now, I guess you can think of my question. If I get emancipated, (legally the age of 21) do I get that money? My parents said it was fine, but I needed to ask my lawyer. I do NOT want to here a speech about how I could blow the money and BLA BLA BLA. I know what I am going to do with it. Just answer if I can get it. (I think I should though because I am LEGALLY considered 21. The restrictions of emancipated are limited to "You can't get married with out your parents permission, you can't drink, you can't buy cigs, and you can't buy alcohol, Must attend school, Cannot vote until the age of 18, and Cannot purchase or possess firearms") Any one KNOW the answer? I don't really want to here, "Well you should be able" I KNOW I SHOULD be able to, but am I?

    You were so busy making an ass of yourself, you didn't ask a clear question. If the money is being held for you until you emancipate by age (reaching the age of majority), we have no reason to doubt that you would get the money at that time.

    If you're asking about getting emancipated before you turn 21, read the stickied threads at the top of the forum. Your state's emancipation statute is very limited.

    Since Mississippi doesn't have an actual statute for emancipation, only case law which makes it possible, generally speaking, yes, you'd get the money because being emancipated would mean you'd simultaneously be cleared to open financial accounts and manage them yourself (the only reason you don't have the money now).

    Mississippi does have an emancipation statute that is focused on enabling minors to enter into contracts.

    Substantial settlements for the benefit of minors are typically held, pending the minor's reaching adulthood, under the supervision of a court. If that's the case, even if a different court said "Young Mr. Mouthy is old enough to enter into contracts," the court supervising the settlement proceeds may nonetheless deem him insufficiently mature to manage the money.
