My question involves criminal law for the state of: Arizona
Hello all,
Quick background of how this got started.
Aug 2009, splash multiple people with water from street as i drive by.
Pulled over, interviewed by police and detective.
Told I am arrested, but not being detained. No Miranda rights.
Left scene, no tickets, info, warnings, signatures, nothing. Just a "wait for it in the mail."
Jan. 2010:
Received a summons to court, State of AZ vs. Me, for 1 charge of Criminal Damage, Class 2 Misdemeanor.
Did some homework, Class 2 is for personal damage under 250 dollars.
Max fine is $750.00 and up to 4 months in jail.
I am a first time offender, a separated father of 2, who supports his ex and 2 kids on only his income. I am concerned that i will face jail time, which in turn will effect my children as I will lose my job.
I also plan on pleading not guilty, as I did not intentionally try and harm anyone or damage anything. Any damage was accidental.
Since this is such a small amount of damage, would anyone advise retaining counsel? What should I expect at court? Arraignment?
